Terms of Service

PlanCycle: PlanCycle.io, supplier. Customer: the organization entering into the agreement. Software: the PlanCycle.io platform including all modules. Service: hosting, management, support and updates.

Prices shown on this marketing site are indicative and exclude VAT. The definitive agreement is established upon signing an individual contract specifying scope, price, term and SLA.

Standard 12-month minimum term from go-live. Thereafter monthly auto-renewal, cancellable with 1 month notice. 90-day money-back guarantee: if you do not see measurable value within the first 90 days, we refund the setup fee and paid monthly fees.

Customer ensures: timely provision of required data and accounts, an authorized decision-maker as contact, reasonable cooperation during the data-readiness scan and go-live, and timely payment according to agreed terms.

PlanCycle ensures: Software availability per agreed SLA, regular updates and security patches, support within contractual response times, compliance with GDPR and NEN-7510 (where applicable).

Software, models and algorithms remain the property of PlanCycle. Customer data remains the property of the Customer. Customer grants PlanCycle a right of use for the data solely for providing the Service and optimizing forecast models for the Customer.

PlanCycle is not liable for indirect damages (lost revenue, missed opportunities, reputational damage). Direct damages are limited to fees paid in the past 12 months. Limitation does not apply in cases of intent or gross negligence.

Neither party is liable for outages caused by force majeure, including but not limited to: Azure outages, internet outages, war, natural disasters, government measures.

Dutch law applies. Disputes will be submitted to the competent court in Amsterdam.
